IRB Hearings & Immigration Appeals
IRB-authorized representation before all 4 divisions — RPD, RAD, ID, and IAD
The 4 Divisions of the IRB
The Immigration and Refugee Board of Canada (IRB) is the country's largest independent administrative tribunal. Mohamed Aboud | RCIC-IRB is authorized to represent clients before all four of its divisions.
Refugee Protection Division (RPD)
The RPD is the first level of decision-making for refugee claims made inside Canada. It holds hearings to determine whether a claimant is a Convention refugee or a person in need of protection. We prepare and represent clients at all stages of their RPD hearing.
Refugee Appeal Division (RAD)
The RAD hears appeals of RPD decisions from claimants and the Minister. It reviews RPD decisions for errors of law, fact, or mixed fact and law, and may admit new evidence under certain conditions. Strict timelines apply — contact us immediately after an RPD refusal.
Immigration Division (ID)
The ID conducts admissibility hearings and detention reviews. It determines whether foreign nationals or permanent residents are inadmissible to Canada due to security, serious criminality, or other grounds. We represent clients in inadmissibility hearings and advocate for release from detention.
Immigration Appeal Division (IAD)
The IAD hears appeals on removal orders, refused sponsorship applications, and residency obligation appeals by permanent residents. We prepare comprehensive record packages and represent clients at IAD hearings, arguing for relief on humanitarian and compassionate grounds where available.
Common IRB Matters We Handle
Sponsorship Refusal Appeals (IAD)
When IRCC refuses a spousal or family sponsorship application, the sponsor may appeal to the IAD. We prepare the appeal record and argue the case at the IAD hearing.
PR Residency Obligation Appeals (IAD)
Permanent residents who have not met the 730-day residency requirement may face removal. The IAD can grant relief on H&C grounds. We build the strongest possible H&C case for your appeal.
Removal Order Appeals (IAD)
Permanent residents subject to removal orders for criminality or misrepresentation may appeal to the IAD. We assess the strength of your appeal and represent you at the hearing.
Detention Reviews (ID)
Individuals detained for immigration reasons have the right to detention reviews at 48 hours, 7 days, and every 30 days thereafter. We advocate vigorously for release from immigration detention.
Admissibility Hearings (ID)
When CBSA believes a person is inadmissible, the ID holds a hearing to determine admissibility. Grounds include serious criminality, organized criminality, security, and health. We represent respondents at ID hearings.
RPD Claim Preparation & Representation
Full-service refugee claim support: BOC form drafting, country condition research packages, disclosure preparation, hearing preparation, and live representation before the RPD member.
Why IRB Representation Matters
IRB proceedings are quasi-judicial hearings governed by rules of evidence and procedure that are unfamiliar to most individuals. A single procedural error or an unprepared answer during an RPD hearing can result in a refusal — potentially leading to deportation.
Represented claimants consistently achieve better outcomes across all IRB divisions. Mohamed Aboud brings deep experience with IRB procedure, country condition evidence, and strategic preparation to every case.
IRB matters involve strict deadlines — missing a deadline can mean the permanent loss of your right to appeal or be heard. Contact us as soon as possible after receiving any IRB notice.
